Galace v. Winners Merchants International L.P., 2026 ONSC 826
The application, filed in 2018, alleged discrimination in employment based on age and disability, as well as reprisal. During the course of prolonged proceedings before the HRTO, the adjudicator made several interim determinations, including a ruling in 2024 that no further medical records were required from the applicant. When the application finally went to hearing, the adjudicator ignored his earlier determination and dismissed the application on the basis that the applicant had failed to provide medical records.
The Court ruled that the adjudicator “either entirely disregarded that ruling or purported to overturn it implicitly without any process. Either is procedurally unfair”.
